Technology Platform Notice

ApexPay Financial Technologies Inc. is a financial technology software provider and not a chartered bank or money services business. Banking, deposit custody, and payment card transmission services are rendered exclusively by authorized depository partner institutions (Members FDIC).

1 Acceptance of Terms

By accessing, creating an account on, or submitting an access request via https://apexpay.io or any affiliated application, you agree to be legally bound by these Terms of Use and all incorporated regulatory guidelines. If you do not agree, you must immediately terminate platform access.

2 Non-Custodial Liquidity Architecture

ApexPay develops automated routing logic, telemetry synchronization protocols, and user interface software. At no point does ApexPay take direct custodial title to user fiat balances or digital assets. All settlements flow through licensed third-party clearing houses, Visa Direct, Mastercard Send, or partner depository accounts.

3 Prohibited Activities

You agree never to utilize ApexPay services for:

Any transaction violating federal, state, or international laws, including sanctions imposed by OFAC or international regulatory bodies.
Money laundering, terrorism financing, or fraudulent chargeback schemes.
Reverse engineering, decompiling, or attempting to discover source code or internal algorithmic routing logic.
Automated spamming, bot scraping, or denial-of-service disruptions against ApexPay infrastructure.

4 Limitation of Liability & Disclaimers

APEXPAY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, APEXPAY SHALL NOT BE HELD LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR DATA RESULTING FROM EXTERNAL PAYMENT RAIL BATCH OUTAGES, TELECOMMUNICATIONS HALTS, OR THIRD-PARTY DEPOSITORY ACTIONS.

5 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved via binding arbitration administered by the American Arbitration Association (AAA) in San Francisco, California.
