Federal & International Compliance Commitment
ApexPay Financial Technologies Inc., together with its chartered depository partner banks and payment processors, maintains strict adherence to the Bank Secrecy Act (BSA), USA PATRIOT Act (Title III), FinCEN regulations, and international Financial Action Task Force (FATF) recommendations. We operate a zero-tolerance policy regarding illicit financial activity.
1 Customer Identification Program (CIP) & Verification Tiers
In accordance with Section 326 of the USA PATRIOT Act, ApexPay and its partner banks implement a multi-tiered Customer Identification Program to verify the identity of every user requesting platform liquidity access, card issuance, or fiat routing:
- • Full legal name & physical residential address
- • Date of birth and government Tax ID / SSN / EIN
- • Verified primary email and mobile number
- • Automated registry validation via electronic clearing
- • Unexpired government passport or national ID scan
- • Real-time 3D biometric liveness face-match
- • Verified proof of address (utility bill / bank statement < 90 days)
- • Corporate articles of incorporation and UBO verification
2 OFAC Sanctions & Politically Exposed Persons (PEP) Screening
All user profiles, counterparty destinations, and transaction payloads undergo automated continuous screening against international sanctions registries prior to routing:
- U.S. Department of the Treasury OFAC: Specially Designated Nationals (SDN) and Consolidated Sanctions lists.
- International Lists: European Union Restrictive Measures, UK HM Treasury Financial Sanctions, United Nations Security Council Sanctions, and Interpol Wanted Notices.
- PEP Identification: Enhanced Due Diligence (EDD) is systematically triggered for foreign and domestic Politically Exposed Persons, their immediate family members, and close associates.
3 Automated Transaction Telemetry & Suspicious Activity Reports (SAR)
ApexPay employs real-time behavioral heuristics and algorithmic telemetry to detect abnormal transaction patterns, including:
- Structuring / Smurfing: Deliberate splitting of payments to circumvent statutory currency transaction reporting thresholds ($10,000 USD equivalent).
- Velocity Anomalies: Sudden high-frequency card generation or routing requests discordant with verified customer profile benchmarks.
- High-Risk Originators: Transfers linked to sanctioned mixers, darknet markets, or flagged high-risk smart contracts.
Where requisite legal thresholds are met, ApexPay and partner financial institutions file Suspicious Activity Reports (SARs) with the Financial Crimes Enforcement Network (FinCEN). Under 31 U.S.C. 5318(g)(2), platform personnel are legally prohibited from disclosing the existence or contents of any SAR to affected parties.
4 Prohibited Jurisdictions
ApexPay does not provide services, issue cards, or process settlements for residents, citizens, or registered entities located in jurisdictions subject to comprehensive U.S. embargoes or FATF Blacklist designations. These restricted regions include, but are not limited to: Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. Any connection attempt originating from restricted IP ranges or sanctioned geofences will be immediately blocked and flagged.
5 Record Retention & Compliance Audit Desk
Under FinCEN Recordkeeping Rule (31 CFR § 1010.410), all identity verification artifacts, ledger transactions, and compliance logs are archived in tamper-evident, encrypted cold storage for a minimum statutory period of five (5) years following account termination.
